Airjet Charters LLP acts exclusively as an intermediary booking agent, connecting clients with direct, certified air operators holding valid permits issued by aviation regulatory bodies.
2. Detailed Legal Terms & Technical Disclaimers
2.1 Nature of Business & Broker Role
Airjet Charters LLP facilitates aircraft charter bookings on behalf of clients. All flights arranged through Airjet Charters LLP are operated by independent third-party direct air carriers who hold valid Non-Scheduled Operator’s Permits (NSOP) or Air Operator Certificates (AOC) granted by the Directorate General of Civil Aviation (DGCA) of India or corresponding foreign civil aviation authorities.
2.2 Technical Operations, Crew & Flight Safety
• Operational Control: The direct air carrier operating the flight retains total, uninterrupted operational control over all aircraft, routes, crew assignments, and flight dispatches at all times.
• Technical Responsibility: The licensed operator is solely and strictly responsible for aircraft airworthiness, technical inspections, pre-flight checks, routine maintenance, fuel management, pilot licensing, and strict adherence to DGCA Flight Duty Time Limitations (FDTL) and Civil Aviation Requirements (CARs).
• Pilot-in-Command (PIC) Authority: The Pilot-in-Command appointed by the operating carrier possesses absolute final authority regarding flight safety, weather clearance, passenger boarding, and flight termination/diversion.
2.3 Delays, Cancellations & Technical Disruptions
Airjet Charters LLP shall not be held responsible, legally liable, or financially obligated for flight delays, route alterations, diversions, or cancellations resulting from:
- Adverse weather conditions, poor visibility, or natural hazards.
- Air Traffic Control (ATC) holds, airport slot constraints, defense airspace restrictions, or VIP movements.
- Unforeseen technical defects, AOG (Aircraft on Ground) maintenance issues, or mechanical issues detected during safety procedures.
- Force Majeure events, labor strikes, civil disruptions, or sudden regulatory/DGCA directives.
Replacement Policy
In case of a technical breakdown or operator-initiated cancellation, Airjet Charters LLP will exert all reasonable efforts to procure a substitute aircraft. Any price differential associated with replacement carriers remains the client’s responsibility, subject to fleet availability.
2.4 Cancellation Policies & Refund Terms
- All cancellations—whether requested by the passenger or mandated by operational/safety constraints—are strictly governed by the specific Charter Agreement / Quotation Contract executed for that booking.
- Cancellation penalties, non-refundable deposit terms, and refund processing schedules are directly tied to the operating NSOP carrier’s terms.
2.5 Insurance, Taxation & Legal Jurisdiction
Insurance Coverage
Airjet Charters LLP does not provide aviation liability insurance. All passenger liability, third-party liability, and baggage coverage are provided directly by the operating air carrier as required under the Carriage by Air Act and international aviation treaties.
Taxation
All quoted rates are subject to applicable taxes, including Indian Goods and Services Tax (GST), passenger utility fees (UDF/PSF), and local airport handling charges.
Governing Law
These terms are governed by the laws of India, and any legal matters shall be subject to the exclusive jurisdiction of the competent courts where Airjet Charters LLP is legally registered.
